Chapter 5. Operations

Standard statement

The agency shall have written procedures for taking a juvenile into custody, including, at a minimum, provisions for the following:

Each bullet must stand alone when establishing compliance, with proofs identified for every lettered requirement.

  1. a.determining whether the juvenile is alleged to have engaged in non-criminal misbehavior (a status offense);
  2. b.determining whether the juvenile is alleged to have been harmed or to be in danger of harm;
  3. c.ensuring that the constitutional rights of juveniles are protected;
  4. d.bringing the juveniles to the intake facility or the juvenile component without delay (unless a juvenile is in need of emergency medical treatment);
  5. e.procedures for fingerprinting and photographing of juveniles; and
  6. f.notifying parents or guardians of juveniles that the latter have been taken into custody.
