Standard statement

The agency shall have a written directive that governs search and seizure without a warrant by agency personnel, to include the following situations:

Each bullet must stand alone when establishing compliance, with proofs identified for every lettered requirement.

1. a.search by consent;
2. b.stop and frisk of an individual under circumstances where the officer has articulable reasons to fear for his/her safety;
3. c.search of a vehicle under a movable vehicle exception;
4. d.at the scene of a crime;
5. e.exigent circumstances, as where the public safety is endangered;
6. f.inventory searches of seized vehicles or other property, and
7. g.other situations authorized by state and federal law.
